All deliveries, services and offers are made exclusively on the basis of the following terms and conditions. We hereby object to counter-confirmations unless we expressly agree to them in writing.
If this due date is exceeded, from the 3rd day after the invoice date, interest on arrears will be charged at 2% above the respective discount rate of the Deutsche Bundesbank. All costs that are caused by late payment, such as extension costs, protest costs, legal fees, etc. are borne by the defaulting buyer. Credits are always given after deduction of the discounts and other discounts granted on the invoice amount. Checks are only considered payments after they have been cashed. If the buyer is in arrears with a due payment or if his financial situation deteriorates significantly, Interspeed LessStress GmbH & Co.KG is entitled to withdraw from the part of the contract that has not yet been performed or to pay cash or secure the goods for further deliveries to be requested without a prior grace period being required.

§1 prices
All prices are exclusive of VAT. They are free-lance and are constantly adapted to market conditions. The costs for packaging disposal in the form of the take-back obligation according to the Packaging Ordinance are included in our prices as a discount.§2 product changes
We reserve the right to make technical and visual changes as a further development of the articles we offer.§3 delivery
The delivery is basically plus shipping costs from the Steinhagen warehouse, from the warehouse of the respective German manufacturer or from a German customs warehouse. Orders below a net value of € 50.00 are only delivered in full (no partial delivery). If the customer still requests partial delivery, we reserve the right to calculate the freight costs incurred by the partial delivery. Orders over € 50.00 will be partially delivered if not all ordered products are available from stock. The one-off partial delivery that arises here generally takes place without the calculation of an additional flat-rate freight charge. If, in addition to the one-off partial delivery, additional partial deliveries are requested by the customer, the full flat rate for freight costs will be charged for these partial deliveries. Back orders below € 15.00 are generally only delivered with follow-up orders. After 3 months without a new order, we reserve the right to cancel back orders under € 15.00.§4 retention of title
The delivered goods remain the property of Interspeed LessStress GmbH & Co. KG until all claims have been paid in full. The buyer assigns the claims from a resale of the reserved goods to Interspeed LessStress GmbH & Co. KG, even to the extent that the goods have been processed. If, in addition to the goods subject to retention of title by Interspeed LessStress GmbH & Co. KG, the processing product contains items that either belonged to the buyer or were only delivered under simple retention of title, the buyer assigns the entire purchase price claim to Interspeed LessStress GmbH & Co. KG. In the other case, Interspeed LessStress GmbH & Co. KG is entitled to a fraction of the claim, according to the ratio of the invoice value of its reserved goods to the invoice value of the other processed objects. The buyer is still authorized to collect the claim. Our authority to collect the claim itself remains unaffected. However, we undertake not to collect the receivables as long as the buyer meets his payment obligations from the proceeds received, is not in arrears with payment and, in particular, there is no order to open bankruptcy or insolvency proceedings or payment is suspended. If this is the case, we can demand that the buyer notify us of the assigned claims and their debtors, provide all the information required for collection, hand over the associated documents and notify the debtor (third party) of the assignment.§5 payment
We deliver on account. The invoices are issued on the day the goods are dispatched; in the case of early delivery, the agreed delivery date is the day of the issue. The invoices are payable 8 days after the invoice date with a 2% discount. §6 transport damage
All deliveries travel at the risk of the customer / customer. The customer is obliged to have open transport damage confirmed by the carrier upon acceptance. The acknowledgment of the damage must be submitted to us immediately. Open defects that have not been confirmed cannot be recognized later and are not insured either. If there is a hidden transport damage or defect, it must be reported to the carrier immediately in writing. Please provide us with proof of registration of the hidden defect immediately. For hidden defects, compliance with deadlines must be observed, in which hidden defects are to be reported after receipt of the goods. The deadlines to be met are: at the post office within 24 hours; on the train within 7 days; at the forwarder within 6 days; for air freight companies within 7 days.§7 wrong orders
In the case of incorrect orders, we charge a processing fee of 20% of the respective goods value, but at least € 10.00. The return must be sent to us free of charge. Only original packaged goods can be taken back. Returns must be provided with an authorization number, which must be clearly visible on the outside of the packaging. You will receive this number from us after consultation. Returns in the warehouse will not be accepted without an authorization number and prepaid returns. Consumables can only be taken back in their original packaging within 4 weeks of purchase. We reserve the right to refuse to take back products that have been specially procured for a customer.§8 cancellations
Cancellations of products that have been specially ordered for a customer or whose order quantity significantly exceeds the normal stock level must be in writing and are only accepted as accepted with the written confirmation of Interspeed LessStress GmbH & Co. KG. If the customer has already received the goods, the provisions of paragraph 7, wrong orders, also apply to cancellations.§9 complaint
We always strive to deliver only absolutely reliable quality products. Should there still be cause for complaint (defective goods or incorrect delivery), send the goods concerned (including a copy of the invoice delivery note and a detailed description of the error) to us free of charge. Processing is not possible without an accurate and detailed description of the error. The return must be sent to us free of charge in the original packaging. Incomplete returns cannot be processed and will be returned to the customer immediately. After repair, the customer receives the product sent free of charge. Please note that in the event of defects in the scope of delivery (missing product or delivery of an unordered product), this defect must be reported to us within 3 days of receipt of the goods. Subsequent complaints cannot be accepted and will be borne by the customer.§10 liability
Liability for consequential damage of any kind resulting from non-delivery or incorrect delivery or non-function of products purchased from us is excluded. Interspeed LessStress GmbH & Co. KG's liability relates exclusively to the value of the goods offered by us.§11 validity
With this offer, shown on the Internet, all previous offers lose their validity. Errors and changes excepted. For foreign customers different terms apply.§12 applicable law
The law of the Federal Republic of Germany applies to these terms and conditions and the entire legal relationship between us and you. The place of jurisdiction for all disputes arising from this contract is Bielefeld. Should a provision of these general terms and conditions or another agreement be or become ineffective, the effectiveness of all other provisions or agreements will nevertheless become effective
